Good evening Wildomar and welcome to our program. My name is Sarah Jensen and tonight we have a very special guest, Steve Bliss, a renowned Trust Attorney here in Wildomar. Steve, thank you so much for joining us.
The Importance of Trusts
Steve, for our viewers who may not be familiar with the concept of trusts, could you briefly explain what they are and why they might be important?
Certainly Sarah. A trust is a legal entity that holds assets for the benefit of another person or people. It’s essentially a way to manage and distribute your property according to your wishes, even after you’re gone. Trusts offer several advantages over simply leaving assets in a will, including avoiding probate, which can be a lengthy and expensive process.
Moreover, trusts provide privacy since the terms of the trust are not public record, unlike wills. There are various types of trusts designed for different purposes, such as asset protection, estate tax reduction, or providing for loved ones with special needs.
The Power of Irrevocable Trusts
You mentioned that there are different types of trusts. Could you elaborate on one specific type and its benefits?
Absolutely. Today I want to focus on Irrevocable Trusts. These trusts, as the name suggests, cannot be easily changed or revoked once created. Consequently, they offer significant advantages for asset protection.
For instance, if you’re concerned about potential lawsuits or creditors, transferring assets into an irrevocable trust can shield them from being seized. The assets are no longer considered yours personally but belong to the trust.
Think of it like putting your belongings in a safe deposit box that only the designated trustee can access. Notwithstanding this advantage, it’s important to remember that irrevocable trusts require careful planning and should be established with the guidance of an experienced attorney.
Navigating Challenges
Steve, have you ever encountered any challenges or unique situations when setting up irrevocable trusts for your clients?
I recall a case involving a small business owner who was facing a potential lawsuit. He wanted to protect his assets but also needed to maintain some control over the business operations. We worked together to design an irrevocable trust that allowed him to transfer ownership of certain assets while retaining limited management rights. It was a delicate balance, but ultimately we were able to achieve his goals and provide peace of mind.
Another instance involved a family concerned about potential estate taxes. By establishing an Irrevocable Life Insurance Trust (ILIT), we were able to remove the life insurance policy proceeds from the taxable estate, saving them significant sums in the long run.
Peace of Mind Through Planning
It’s clear that trusts can play a vital role in protecting assets and ensuring your wishes are carried out. Can you share any statistics that highlight the importance of trust planning?
According to a study by the American Bar Association, approximately 50% of Americans die without a will or trust. This means their assets are distributed according to state intestacy laws, which may not align with their desires. Creating a trust can help avoid this potential problem and ensure your loved ones are taken care of.
