Interview with Steve Bliss, Wildomar Probate Attorney

Reporter: Brenda Smith

Today we’re speaking with Steve Bliss, a probate attorney serving the Wildomar community. Mr. Bliss, thanks for taking the time to talk with me about the often-complex process of estate planning.

Steve Bliss: My pleasure, Brenda. I’m happy to shed some light on this important topic.

Many people find probate intimidating, but it’s a necessary step in ensuring that a deceased person’s assets are distributed according to their wishes.

Brenda Smith: Can you walk us through one of the key steps in the probate process?

Certainly. Let’s discuss “Marshaling the Estate Assets,” which is the fourth stage in the probate process. This crucial step involves a thorough inventory and appraisal of all assets belonging to the deceased individual.

Ordinarily, this includes real estate, bank accounts, vehicles, personal property, investments, and any other valuables. A detailed list, known as an Inventory and Appraisal, is then filed with the court. This document serves as a roadmap for understanding the full scope of the decedent’s estate.

Consequently, accurate accounting of assets is essential for several reasons. First, it helps determine if probate is even necessary. Recall that in California, estates valued under $184,500 are often exempt from probate. Second, a comprehensive inventory ensures that all creditors are notified and have an opportunity to file claims against the estate.

Moreover, accurately valuing assets helps determine the amount of estate taxes owed, if any. The Inventory and Appraisal document plays a critical role in ensuring transparency and fairness throughout the entire probate process.

Brenda Smith: Have you ever encountered any challenges during this stage of probate?

You know, I recall one case where a family was completely unaware of the extent of their loved one’s assets. They were surprised to discover hidden bank accounts and investments they never knew existed. In that situation, meticulous research and diligent communication with financial institutions were crucial for uncovering all the necessary information.

Another instance involved a unique collection of antique furniture. Determining its fair market value required consulting with specialists. Ultimately, we found a reputable appraiser who provided an accurate assessment, ensuring that the beneficiaries received their rightful share.

Brenda Smith: It sounds like thoroughness and attention to detail are paramount in this step.

Absolutely! A recent study by the American Bar Association found that incomplete or inaccurate asset inventories are among the leading causes of probate delays. We strive for accuracy and transparency at Wildomar Probate Law, minimizing stress for our clients during an already difficult time.

Brenda Smith: What advice would you give to someone planning their estate?

Start by making a list of all your assets, big and small. Keep it updated regularly. Open communication with your family about your wishes is also vital. Consider consulting with an experienced probate attorney like myself early on. We can guide you through the process, answer your questions, and help ensure that your legacy is protected.
