Interview with Steve Bliss
Good afternoon and welcome back to our segment on legal matters important to the Escondido community. Today we have the pleasure of speaking with Steve Bliss, a seasoned probate attorney here in Escondido. Steve, thanks for joining us.
Steve Bliss: It’s my pleasure to be here.
Today, we’re going to delve into a crucial aspect of estate planning: probate. Many people are unfamiliar with this process and what it entails. Could you shed some light on one key step within the probate journey?
Steve Bliss: Certainly. One of the most fundamental steps is “Marshaling the Estate Assets.” This involves meticulously identifying, inventorying, and valuing all assets belonging to the deceased person’s estate. It’s like taking a snapshot of their financial life.
Ordinarily, this includes checking bank accounts, investment portfolios, real estate holdings, vehicles, personal belongings – anything of value. A detailed list is then compiled and formally submitted to the court in the form of an Inventory and Appraisal (Form DE-160/161). This document ensures transparency and accountability throughout the probate process.
Consequently, it’s crucial to be thorough and accurate during this step. Missing assets can lead to complications and potential legal disputes down the line. I always advise my clients to gather as much information as possible about their loved one’s financial affairs before initiating probate proceedings.
Moreover, accurately valuing assets can sometimes be challenging, particularly with unique items like artwork or antiques. In these cases, it may be necessary to consult with appraisers to determine fair market value.
I remember a case where we were handling the estate of a client who was an avid collector of vintage cars. Accurately valuing his collection proved to be quite a task. We ultimately brought in a specialized automotive appraiser, which ensured that the assets were appropriately reflected in the Inventory and Appraisal.
Notwithstanding these challenges, “Marshaling the Estate Assets” is an essential step in ensuring a smooth and efficient probate process. Remember, it’s about creating a clear and comprehensive picture of the deceased person’s financial legacy.
