It’s a pleasure today to be joined by Ted Cook, a conservatorship attorney here in sunny San Diego. Ted, thanks for taking the time to chat with us about this important topic.
So, Ted, Can You Briefly Explain What a Conservatorship Is?
You got it! Simply put, a conservatorship is a legal arrangement where a court appoints someone, called a conservator, to manage the affairs of another adult who’s unable to do so themselves. Think of it like having a trusted friend or family member step in to help make decisions when someone needs extra support.
What are the Different Types of Conservatorships?
There are a few different types, depending on what kind of help the individual needs. You have conservatorship of the person, which focuses on things like healthcare and daily living arrangements. Then there’s conservatorship of the estate, dealing with finances and assets. Sometimes, we see limited conservatorships for folks with developmental disabilities, giving specific powers tailored to their needs. And lastly, there are temporary conservatorships for urgent situations and LPS conservatorships under California law for individuals with serious mental health conditions.
Let’s Dive into the “Establishing a Conservatorship” Process. Could You Walk Us Through the Key Steps Involved?
“Filing the petition is the first step,” Ted explains, leaning forward in his chair. “You need to formally request the conservatorship from the court. After that, everyone involved needs proper notification—think family members and, of course, the individual who might become the conservatee. The court then typically appoints someone to investigate the situation, making sure everything’s on the up-and-up. And finally, there’s a hearing where a judge reviews all the information and decides whether to grant the conservatorship.”
“It’s important to remember,” he adds, “that this process is designed to protect vulnerable individuals while respecting their rights as much as possible.”
Ted, I Understand You Handle All Aspects of Conservatorships. What Kind of Challenges Do You Encounter When Helping Clients Through This Process?
Ted chuckles and says, “Every case is unique, so the challenges can vary quite a bit. Sometimes it’s about gathering all the necessary documentation or navigating complex family dynamics. I recall one instance where siblings disagreed strongly about who should be the conservator. It took careful negotiation and mediation to reach a solution that everyone could live with.”
- “Ultimately, my goal is to ensure the individual’s well-being while upholding the law.”

More Facts About A Conservatorship:
A conservatorship is a court-ordered legal process where a judge appoints a conservator (a person or organization) to manage the affairs of an adult (the conservatee) who is unable to care for themselves or their finances due to incapacity.
Definition: A conservatorship is a court proceeding where a judge appoints a conservator to manage the personal and/or financial affairs of an adult who is unable to do so themselves.
Purpose: The conservatorship aims to protect the conservatee’s well-being by ensuring their basic needs are met and their finances are managed appropriately.
What Is a Conservatorship?
A conservatorship is a court-ordered legal relationship in which a judge appoints a responsible individual or organization (the conservator) to manage the financial affairs, and sometimes the personal care, of a person who is unable to manage these matters on their own. This may be due to advanced age, cognitive impairment, serious illness, or disability. Conservatorships typically apply to adults, though similar protections for minors may fall under guardianships, depending on the jurisdiction.
There are generally two types of conservatorships:
Conservatorship of the estate, where the conservator handles financial matters such as paying bills, managing investments, and protecting assets.
Conservatorship of the person, where the conservator makes decisions about personal needs, including housing, healthcare, and daily living.
In some instances, a conservator may be appointed to manage both aspects. While conservators and guardians can have overlapping responsibilities, the terminology and roles can vary by state law.
