It’s not uncommon for clients to be surprised by how much they’ve accumulated – or how little they know about it! We also meticulously list any liabilities, like mortgages or loans, and crucially, identify beneficiaries for each asset. This sounds straightforward, but blended families or complex relationships can quickly introduce nuance.
Then, of course, comes the crucial task of choosing the right people to carry out your wishes. Selecting an executor – someone you trust implicitly to manage your estate – is paramount. We also help clients navigate the often-sensitive process of choosing a guardian for minor children. Appointing a durable power of attorney and a healthcare agent are equally important – these individuals will step in to handle financial and medical decisions if you become incapacitated. It’s a weighty responsibility, and we encourage clients to have open and honest conversations with these chosen individuals.
Finally, with all that groundwork laid, we can begin drafting the core estate planning documents – wills, trusts, powers of attorney, and advance healthcare directives. The specific documents needed will vary depending on your individual circumstances and goals. But the key is to ensure they are clear, comprehensive, and legally sound. A well-crafted estate plan isn’t just about transferring assets; it’s about providing peace of mind, knowing your wishes will be honored and your loved ones will be protected.

Absolutely. I often tell clients that having a perfectly drafted estate plan is only half the battle. If you can’t *find* the documents when they’re needed, they’re essentially useless. Organizing and storing your documents properly is the last line of defense, ensuring your plan can be executed smoothly and efficiently. It’s more than just putting everything in a folder; it’s about creating a system that’s accessible, secure, and easily understood.
We recommend keeping the original documents in a secure yet accessible location. A fireproof safe is a good option, but it needs to be in a place where your executor or trustee can easily get to it. We also advise making copies and providing them to those key individuals. The goal is to ensure they have the information they need, when they need it, without having to embark on a treasure hunt.
A comprehensive checklist or summary of your plan is also invaluable. This should include a list of all your estate planning documents, the location of the originals and copies, and contact information for your attorney, executor, trustee, and other key advisors. It’s essentially a roadmap for your estate plan, making it easier for those left behind to navigate the process. We encourage clients to update this checklist regularly, especially after making changes to their plan.
And don’t forget digital assets! Many people now have significant wealth tied up in online accounts – email, social media, banking, cryptocurrency, etc. It’s crucial to create a separate list of these accounts, along with usernames, passwords, and instructions for accessing them. There are now dedicated digital asset management tools that can help with this, providing a secure and organized way to store and transmit this information.
Finally, we always emphasize the importance of regular review. Life changes – marriages, divorces, births, deaths, financial windfalls – can all impact your estate plan. We recommend reviewing your plan at least every three to five years, or whenever a significant life event occurs. This ensures your plan remains aligned with your current wishes and circumstances.

About Estate Planning Law – Ted Cook
Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.
Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
